Family Law Legislation

Below is a summary of some of the legislation related to Family Law that was passed during the 2009-2010 Georgia Legislative Session and signed by the Governor.

HB 145 – To amend Code Section 19-6-15 of the O.G.C.A., relating to guidelines for determining amount of child support. The amendment revises the definition of parenting time deviation, clarifies the procedure for submission and attachment of child support worksheets, and revises the calculation for low income deviation. (Signed by Governor April 21, 2009.)

HB 184 – To amend Code Section 19-3-40 of the O.G.C.A., relating to marriage license and ceremony. The amendment recommends that each applicant applying for a marriage license obtain a blood test for sickle cell disease prior to obtaining a marriage license.  (Signed by Governor April 30, 2009.)

HB 303 –To amend Code Section 49-5-41 of the O.G.C.A., relating to persons and agencies permitted access to records containing reports of child abuse. The amendment authorizes solicitors-general and assistant solicitors-general to have access to such reports for official purposes. (Signed by Governor May 20, 2010.)  

HB 388 – To amend Code Section 19-8-42 of the O.G.C.A., relating to adoption. The amendment provides that a child born as a result of a relinquished embryo shall be the legal child of the recipient and that a recipient parent may petition for an expedited order of adoption or parentage. (Signed by Governor May 5, 2009.)
 
HB 1085 – To amend Code Section 15-11-58 of the O.C.G.A. relating to family reunification plans when a child has been removed from the home under court order. The amendment creates requirements for what must be contained in such a reunification plan and includes a requirement that DFCS staff assist the child in developing a transition plan personalized by the child before he/she turns 18. (Signed by Governor May 27, 2010.)

HB 1118 - To amend Code Sections 19-11-12 and 19-11-26 through 19-11-29 of the O.C.G.A., relating to review procedures for IV-D agency support orders and to clarify terms relating to accident and sickness insurance coverage for children, respectively. The amendment to Code Section 19-11-12, requires that IV-D agency orders that are active TANF cases to be reviewed after 36-months from the date of issue, without a request. The amendment to code Sections 19-11-26 through 19-11-29 clarifies terms relating to obligors and obligees that provide or receive accident and sickness insurance for children. SB 69 – To amend Code Sections 19-7-5 and 49-5-40 of the O.G.C.A., relating to domestic relations and social services, respectively. The amendment to Code Section 19-7-5 expands the definition of “sexual exploitation”. The amendment to Code Section 49-5-40, revises definitions relative to the reporting of child abuse and deprivation records. (Signed by Governor May 5, 2009.)
